The parties involved in Police Chief Frank Ingemi's lawsuit against the town discussed the prospect of settlement in a closed meeting Monday night.
Ingemi sued town government, Mayor John DiDonato and then-Councilman Rock Colasurdo in October 2007, seven months after he was cleared of the harassment and insubordination complaints brought by DiDonato and Colasurdo.
The chief's countersuit claimed the pair targeted him after he failed to find evidence the Ku Klux Klan had planted asbestos under the town hall, evidence that could have helped accelerate their political party's plans to build a new town hall.
Attorneys' correspondence with the U.S. District Court confirms the case was a topic of the closed session, although the council did not say so when the open meeting began.
It was not clear whether other issues were also discussed. The session began at 5 p.m., an hour earlier than usual.
The parties are scheduled to have a status conference by telephone Dec. 5. The council has set a special closed session Dec. 8, citing unspecified "personnel and litigation" matters.
Ingemi is represented by the Atlantic City firm Jacobs & Barbone; the town, DiDonato and Colasurdo are represented by Barker, Scott & Gelfand, of Linwood.
